Federal Hemp Ban Delayed + What It Means for Hemp-Derived THC Drinks in New Jersey

North Canna

If you’ve been following along on our hemp ban coverage, you know it’s been quite a year, especially for hemp-derived THC drinks. This year, New Jersey loosened some restrictions earlier, allowing licensed cannabis dispensaries like us to sell hemp-derived THC beverages like CANN, Blurr, North Canna and Canyon Water.

Good news: the federal government has officially pushed its hemp deadline back another month (December 11, 2026). Bad news: New Jersey hasn’t followed suit.

So, where does that leave your favorite THC bevs? Let’s catch up.

U.S. Federal Hemp Ban Pushed to December 11

On September 2, 2026, the President signed a short-term government funding bill that pushed back most of the federal hemp restrictions from November 12 to December 11, 2026. There’s an important distinction: the ban hasn’t been overturned. It’s just been delayed.

Under the federal law passed in November 2025, the definition of hemp is changing. Currently, hemp products generally qualify under the federal definition if they contain no more than 0.3% delta-9 THC by dry weight. The new law introduces a much stricter limit with no more than 0.4 milligrams of total THC per container.

Some of our favorite bev brands are already figuring out what comes next. We’re seeing brands explore THC-free versions of their drinks, while others are looking at entering state-licensed cannabis markets, where THC beverages can still be sold through dispensaries like Pure Blossom. And it’s important to note this is not just beverages. This applies to ALL hemp-derived THC products over 0.4 milligrams of THC.

Could the Federal Deadline Change Again?

That extra month gives lawmakers and the hemp industry a little more time to figure out what comes next. Industry advocates have been pushing for an alternative to the ban that would keep intoxicating hemp products legal, but with clearer rules around testing, labeling, age restrictions and other safeguards.

In short, they’re pushing for regulation rather than elimination.

On the other side, supporters of tighter restrictions point to concerns around inconsistent testing, misleading labels and intoxicating products being sold outside state-licensed cannabis markets.

It’s a complicated debate for an industry that has grown considerably since hemp was federally legalized under the 2018 Farm Bill.

For now, December 11 remains the federal deadline. Whether Congress makes additional changes is something we’ll be watching and will continue to update you on.

NJ’s November Deadline Stays Put (For Now)

Although the federal government extended its deadline, **New Jersey is sticking with its original November timeline (November 13, 2026).**

Under current NJ state law, licensed cannabis retailers like Pure Blossom and licensed liquor retailers can sell qualifying intoxicating hemp beverages through November 13, 2026.

Starting November 14, hemp-derived THC beverages containing more than 0.4 milligrams of total THC per container will be regulated as cannabis products in New Jersey. That means they’ll need to be produced by a licensed New Jersey cannabis manufacturer and sold through a licensed cannabis retailer.

So, what does that mean for the drinks we’ve been enjoying all summer? They can’t simply stay on our shelves as-is. Brands that want to continue selling THC beverages in New Jersey will need to find a path that complies with the state’s cannabis regulations.

Is NJ Considering An Extension?

Yes! And there’s been some movement.

On October 15, New Jersey’s Senate Judiciary Committee and Assembly State and Local Government Committee voted to advance S4635/A5604, which would bring the state’s timeline in line with federal law. If passed, the bill would replace New Jersey’s fixed November date with the Federal date.

That could give retailers and hemp beverage brands in New Jersey some extra breathing room. But for now, nothing has changed. The extension has not been enacted, so we’re still working with November 13 as the last day.
